Terms of sale
1. GENERAL
1.1 By purchasing goods from us, whether through our website www.tethys-design.com the "Website" or otherwise, you agree to these terms and conditions, unless otherwise agreed between you and us in writing.
1.2 Please read these terms and conditions of sale carefully before ordering any goods from us. You must accept these terms and conditions and acknowledge our privacy policy before placing an order. You can view the most recent version of the terms of sale at any time on this page.
1.3 If you are acting on behalf of a legal entity or other form of enterprise, these terms of sale do not apply in their entirety. Please refer to section 10 for full terms and conditions applicable to our business customers.
2. PRICE AND PAYMENT
2.1 Prices on the website are quoted in the currency of your country (where available). Unless otherwise indicated, all prices include taxes. We reserve the right to change prices on our website without notice.
2.2 If we charge shipping fees for your order, these will be added to the checkout process before you place your order.
2.3 You can pay by credit card or PayPal.
2.4 Unless otherwise stated, all prices include all duties and taxes.
3. CONTROLS
3.1 You must be over the legal age in your country or have the permission of your parent or legal guardian to purchase goods from us.
3.2 By placing an order, you confirm that you have read and accepted the terms and conditions of sale and that you have read and understood the privacy policy. Orders are only valid for us once we have confirmed your order in writing by sending an order confirmation to the e-mail address you have provided.
3.3 We reserve the right to cancel orders due to special circumstances, such as product out of stock, technical problems or errors on our website. We also reserve the right to change the price of a product after you have placed an order, but before delivery of the product, upon prior written notice. You will have the right to cancel your order if we have increased the price of your order.
3.4 If you place an order as an individual, you hereby acknowledge that the products are intended primarily for personal, non-commercial use. For commercial use, section 1.4 applies.
4. RETURNS AND RIGHT OF WITHDRAWAL
4.1 You have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period will expire after 14 days from the date on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
4.2 To exercise the right of withdrawal, you must inform us of your decision to cancel the contract in an unequivocal statement by post or e-mail. To exercise your legal right of withdrawal, please send an e-mail to contact@tethys-design.com with your name, order number and a clear statement explaining that you wish to withdraw from the contract. If you live in the EU, you can also use the sample withdrawal form below:

4.3 In order to comply with the withdrawal period, it is sufficient to send your request concerning your exercise of the right of withdrawal before the expiry of the withdrawal period.
4.4 If you withdraw from the contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery type offered by us), without undue delay and in any event no later than 14 days from the date on which we are informed of your decision to withdraw from the contract. We will make this refund using the same means of payment you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of this refund. We may, however, withhold the refund until we have received the goods or you have provided proof that you have returned the goods, whichever is the earlier.
4.5 You must return the goods or hand them over to us without undue delay and in any event no later than 14 days from the date on which you notify us of your withdrawal from the contract. The deadline is met if you return the goods before the 14-day period has expired.
4.6 You must bear the direct cost of returning the goods. We will calculate the costs and send you a shipping label for the return shipment. Returns should be sent to the following address:Tethys Design3 rue de chez roger, 87700 Saint-Priest-Sous-Aixe
4.7 You are only responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.
5. GUARANTEES
5.1 Our products carry a 2-year commercial warranty from the date of purchase. The commercial warranty covers manufacturing defects that appear during the warranty period, to the exclusion of any defect resulting, for example (but not limited to), from mistreatment, abnormal use, wear and tear or accidents.
5.2 If you live in the EU/EEA, you are entitled to a statutory warranty in respect of subjective and objective conformity for a period of 3 years from the date you received the goods, in addition to the commercial warranty. You must inform us of the defect within a reasonable period of time after you become aware, or should have become aware, of the defect. The legal warranty does not apply in respect of defects caused by, for example, abuse, abnormal use, wear or accidents.
5.3 You can exercise your commercial and legal warranty rights by sending an e-mail to contact@tethys-design.com.
5.4 We will examine all returned goods and determine whether the defect is covered by the commercial or legal warranty. If we determine that the defect is covered by the warranty, we will, at our sole option, either (1) repair the good; (2) replace the good in part or in whole; or (3) refund the price. If you have returned the goods to us and we determine that the defect is not covered by any warranty, you agree that we may charge you a handling fee of EUR 20 (or the equivalent in the currency of your order) plus shipping costs to return the goods to you.
6. LIMITATION OF LIABILITY
6.1 Unless we have acted with gross negligence or intent, our liability to you under these conditions of sale will be limited to direct losses and to an amount equal to the price paid by you for the goods in respect of which the liability arose. We shall not be liable for indirect losses, losses to your business or losses which we could not have foreseen at the time of entering into the contract with you, nor which we could reasonably have avoided or overcome.
6.2 We do not guarantee that all images on our website reflect the exact appearance of our products, as images may be affected by the type and quality of the monitor you are using and its resolution. We always strive to describe our products fairly.
7. AFFECTATION
Neither we nor you may assign any rights or obligations under these terms of sale to any third party. We may, however, assign the right to receive payment from you to a third party without your consent.
8. DIFFERENTS
8.1 We will always endeavour to resolve any dispute with you mutually. Please contact us at contact@tethys-design.com.
8.2 If you are dissatisfied with the manner in which we resolve or endeavour to resolve any such dispute, or if you do not wish to engage directly with us in respect of the dispute, you are advised that an alternative dispute resolution procedure is made available by the European Commission to consumers within the EEA through the online dispute resolution platform available from ici.
9. Divers
9.1 We will process your personal data in accordance with our privacy policy. By purchasing products from us, you acknowledge that you have read and understood the Privacy Policy.
9.2 We, or our licensors, are the owner of all content on our website. The content is protected by copyright, trademark and/or other rights.
